Design services terms
These Terms apply when you book, pay for, approve, or authorize design services from BP Design Group LLC ("BP Design Group," "we," "us," or "our"). By checking the acceptance box, paying a fee or deposit, approving a proposal or invoice, or otherwise authorizing us to begin, you ("Client," "you," or "your") agree to these Terms.
1. Our Services
BP Design Group provides residential interior design and space-planning services, including consultations, design plans, product and finish selections, renderings, sourcing, and related design support.
We are a design firm—not a contractor, architect, engineer, plumber, electrician, structural professional, or building-code official. We do not perform or supervise construction, demolition, installation, trade work, inspections, or permitting.
You hire and pay your own contractors and other professionals. They are responsible for construction methods, field conditions, structural requirements, permits, code compliance, safety, installation, workmanship, and final verification of the project.
Our plans and renderings communicate design intent only. They are not construction, engineering, permit, shop, or fabrication drawings.
2. Design Packages
One Room — $250
Includes one in-home consultation, one phone consultation after the home visit, one design plan and rendering, and one revision round.
Two Rooms — $500
Includes one in-home consultation, one phone consultation after the home visit, design plans and renderings for two rooms, and two revision rounds.
Three or More Rooms — $250 per room
Includes one in-home consultation, one phone consultation after the home visit, a design plan and rendering for each selected room, and two revision rounds.
Three-room packages ($750) are paid in full when booked. Projects of four or more rooms require a $1,000 deposit, applied toward the package total, with the balance due when the designs are delivered. Projects of more than ten rooms are quoted individually.
A "revision round" means one consolidated set of requested changes. A new design direction, additional room, substantial scope change, or work resulting from previously undisclosed conditions is additional work.
We generally aim to deliver the initial design within three business days after the home visit. This is an estimate, not a guaranteed completion date, and may be extended while we are waiting for information, decisions, approvals, access, or circumstances outside our reasonable control.
3. Additional Services & Payment
Additional revisions are $200 each. Additional consultations and other design services are $300 per hour.
We will tell you about additional charges and obtain your approval before beginning additional billable work. Any estimate of hours or cost is an estimate unless expressly identified as a fixed price.
Hourly services require a $600 advance deposit. The deposit is applied toward authorized services and is not a separate fee or minimum charge. Any unused amount will be refunded after services end and all outstanding charges are satisfied.
If charges exceed the deposit, we will invoice the balance. Invoices are due within 24 hours of delivery unless otherwise stated. We may pause work on overdue accounts.
Payments made by ACH or bank transfer may take several business days to clear, and we may wait for cleared payment before beginning or continuing services.
4. Cancellations & Rescheduling
Cancel at least 48 hours before your home visit for a full refund.
Cancellations made less than 48 hours before the visit, missed appointments, and cancellations after the home visit are non-refundable.
You may reschedule once. There is no fee with at least 24 hours' notice. Less than 24 hours' notice may result in a $250 rescheduling fee. Further rescheduling may require an additional fee or new booking.
If hourly services are cancelled after work begins, you are responsible for services already performed and authorized non-cancellable costs. Any unused deposit will be refunded.
Nothing in these Terms limits a refund or cancellation right that cannot legally be waived.
5. Measurements & Construction
Measurements we take are for design and visualization purposes and are not final construction, fabrication, installation, or ordering dimensions.
Before ordering products or beginning work, your contractor, installer, supplier, or fabricator must independently verify all dimensions, clearances, existing conditions, utilities, structural requirements, and applicable codes.
You must tell us about known site conditions, building restrictions, association requirements, or other conditions that may affect the design.
BP Design Group is not responsible for construction methods, job-site safety, scheduling, workmanship, contractor performance, code compliance, or costs resulting from a third party's failure to verify measurements or project conditions.
If any part of a design cannot safely or lawfully be installed as shown, the appropriate qualified professional must resolve the issue before work proceeds.
6. Renderings, Products & Third Parties
Renderings, drawings, samples, and digital images communicate the design concept. Actual colors, materials, textures, proportions, finishes, and lighting may differ.
Product pricing, availability, specifications, shipping, lead times, warranties, returns, and discontinuations are controlled by third parties and may change without notice.
Unless we expressly agree otherwise in writing, products are purchased directly from the applicable seller. You or your contractor must verify product dimensions, specifications, compatibility, pricing, and availability before purchasing.
BP Design Group is not responsible for defects, supplier errors, shipping damage, delays, discontinued products, price changes, or the acts or omissions of contractors, installers, manufacturers, suppliers, delivery companies, or other independent third parties.
Budgets and cost discussions are for planning purposes only. We do not guarantee a final construction cost or budget.
7. Client Responsibilities, Changes & Delays
You agree to provide safe access to the project, accurate information about the property and your goals, timely decisions and feedback, and any approvals required by a landlord, association, municipality, or other authority.
You are responsible for hiring qualified contractors and tradespeople and for project decisions you approve.
Changes to the rooms, layout, design direction, selections, or other material requirements may constitute additional work. We will obtain your approval before performing additional work that requires an additional fee.
We are not responsible for delays outside our reasonable control, including Client, contractor, supplier, shipping, product, weather, utility, government, or building-access delays.
If we are waiting for information, approval, or feedback for 30 days, we may close the project as inactive. Reactivation is subject to availability and may involve additional fees if the design must be updated.
8. Design Ownership & Photography
BP Design Group retains ownership of its original plans, renderings, drawings, concepts, layouts, presentations, and other design materials.
After all applicable fees are paid, you receive a limited, non-exclusive, non-transferable license to use the final materials only for the property for which they were created. You may share them with professionals working on that project, but may not sell, commercially distribute, license, or reuse them for another property without our written permission.
We may ask permission to photograph a completed project for our portfolio, website, social media, advertising, or other business purposes. We will not enter your property to photograph it or publish your name or street address without permission.
Previously authorized photo use may be withdrawn for future use where reasonably practicable, but materials already published, printed, distributed, or submitted do not have to be recalled.
9. Liability & Termination
To the fullest extent permitted by law, BP Design Group will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from our services.
To the fullest extent permitted by law, BP Design Group's total aggregate liability relating to a project will not exceed the design fees actually paid to BP Design Group for that project.
These limitations do not apply to BP Design Group's fraud, willful misconduct, gross negligence, or liability that cannot legally be excluded or limited.
We may suspend or terminate services for overdue payments, unsafe conditions, material scope changes without approval of additional fees, requests outside our qualifications or lawful scope, or circumstances outside our reasonable control.
If we terminate for reasons other than your breach, we will refund prepaid amounts for services not performed, less authorized non-refundable costs. You remain responsible for services already performed and authorized expenses.
10. General Terms
Contracts, approvals, invoices, notices, and project communications may be electronic. Checking an acceptance box, electronically approving a proposal or invoice, paying an applicable fee or deposit, or otherwise electronically authorizing services evidences your agreement to these Terms.
These Terms are governed by Illinois law, except where applicable law requires otherwise.
A larger or custom project may have a separate agreement. If it expressly conflicts with these Terms, the separate agreement controls for that project.
These Terms, together with the applicable booking, proposal, invoice, and documents expressly incorporated into them, constitute the agreement for the applicable services. Material changes to scope or pricing must be agreed to in writing or electronically approved by both BP Design Group and the Client.
If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision once does not waive it.
We may update these Terms for future projects. The version in effect when you book or approve your project continues to govern that project unless both parties agree otherwise.
